The 4-step EB-3 process
Step 1 PERM
The US employer applies to the US Department of Labor (DOL) for labor certification for the position – the employer files and pays the fees.
Step 2 I-140
Once PERM is approved, the employer files the immigrant petition with US Citizenship and Immigration Services (USCIS).
Step 3 Visa Bulletin
Wait for your turn under the monthly visa chart; when your turn comes, NVC collects your fees and documents.
Step 4 Interview
Medical exam and interview at the US Consulate, or adjustment of status if you are already in the US.
No one can guarantee processing times. Track it yourself: Visa Bulletin · PERM (flag.dol.gov) · I-140 (egov.uscis.gov).
What is EB-3?
EB-3 is a US employment-based immigration category. The Other Workers group covers unskilled jobs that do not require a degree or much experience. A US employer sponsors you; if the case is approved, the worker and their spouse and unmarried children under 21 may receive green cards.
Labor certification: confirms there are not enough US workers for the position. The first step.
The immigrant petition the employer files with USCIS after PERM is approved.
Usually the date DOL receives the PERM – like your “place in line”.
The monthly visa chart. If your Priority Date is before the date on the chart, your case moves forward.
National Visa Center: collects fees and documents, then sends the case to the Consulate to schedule the interview.
Is EB-3 Other Workers (unskilled) right for you?
5 questions to ask yourself before you start. There are no right or wrong answers.
Ready for manual work?
Restaurants, hotels, laundries, food processing – long hours on your feet, lifting, shift work.
Willing to move where the job is?
You work for the sponsor in that specific city, often a small one.
Patient enough to wait years?
PERM, I-140, waiting on the Visa Bulletin, then the interview. No one can guarantee the timeline.
Are your documents ready?
Civil documents, police certificates and a medical exam as required by the US Department of State.
Have you budgeted for the whole family?
Your spouse and children under 21 can come too, but costs for dependents are significant.
FAQ
Is GJO a recruiting company?
No. GJO is an independent information & referral page. It does not sponsor or recruit directly. With your consent, GJO refers you to a partner it has looked into. All fees are charged by the partner under their own contract – GJO never charges you.
Is a green card guaranteed?
No one can guarantee a visa or green card outcome, because the decision belongs to US immigration authorities. Be careful with anyone who “guarantees” results.
How much does it cost and how long does it take?
It depends on the program and the monthly Visa Bulletin. Message GJO with where you are now, which job you are interested in, and whether you are going alone or with family – GJO will send you detailed information for your situation.
Can my family come with me?
Yes: your spouse and unmarried children under 21. Costs for dependents are significant, so ask for details before you decide.
Do I need good English?
Many EB-3 Other Workers jobs do not require good English, but basic communication helps in the interview and at work. Specific requirements depend on the job.
What if I am already in the US?
If you are in the US, an immigration attorney needs to review your specific case – GJO cannot assess it for you, but can connect you with a suitable partner/attorney if you wish.
Do I need to send my passport or ID card to GJO?
No. Do not send your passport, ID card (CCCD) or photos of documents through GJO – GJO only needs your name and what you are looking for. Documents are provided only to the partner when you sign a contract.
Message GJO
Tell GJO whether you are in Vietnam or the US, which job/city you are interested in, and whether you are going alone or with family. GJO replies the same day and only passes your information to a partner with your consent.
Please do not send your passport, ID card (CCCD) or photos of documents by message.
